Terms of Service

Effective October 22, 2026 · Anni Planner (anniplanner.com), operated by Jon Hegreness, Arizona, USA

These terms are the agreement between you and Jon Hegreness, the operator of Anni Planner ("Anni", "we"), for use of anniplanner.com and its related pages and portals. By creating an account or using the service you agree to them. If you are accepting for a school or district, you confirm you have authority to do so.

1. The service

Anni is a digital classroom planner for teachers: lesson planning, schedules, class lists and records, printable substitute plans, limited time-boxed sharing with parents and substitutes, and student game portals a teacher controls. Anni is currently in beta. During beta, access is by invitation or access code and is free for the school year in which the code is issued; if paid plans are introduced, existing users will get clear notice and pricing before anything is charged, and no stored payment method exists until then (we do not collect payment details today).

2. Your account

You must be an adult educator (or school staff) to hold an account. Keep your password private, use the security features we provide, and tell us promptly at the contact below if you believe your account is compromised. By creating an account you confirm that you use Anni at your school's direction and consistent with its policies, and that you have the authority, under those policies, to keep the classroom records you keep in Anni. You are responsible for activity under your account.

3. Your content and student records

Everything you put into Anni remains yours (or your school's, where school policy says so). You give us only the limited license needed to store, process, display, print, back up, and transmit it so the service works: we claim no other rights. Student information receives the protections in our Privacy Policy and Student Data & FERPA statement, which are part of these terms: no sale, no advertising use, no profiling outside classroom purposes, deletion on school request, and breach notice as Arizona law requires. Where these terms and a signed Data Privacy Agreement with a school differ, the signed agreement wins for that school's data.

4. Acceptable use

You agree not to: misuse the service to violate law or school policy; keep data in Anni you are not authorized to hold; attempt to access another account or another teacher's data; probe, overload, or interfere with the service's security or operation; or resell access. Share links you create (substitute plans, absent work, parent views) are capability links: anyone holding the link can view that page until it expires, so share them the way you would share the paper they replace. We may suspend or terminate accounts that endanger other users' data, with notice where practical.

5. Service changes and availability

Anni is actively developed and features will change, and occasionally be removed, as the product evolves. We aim for continuous availability but do not promise it; maintenance, our providers' outages, and events outside our control can interrupt the service. Nightly off-platform backups protect your data, and you can print or export your materials at any time. If we ever discontinue the service, we will give at least 60 days' notice and a window to retrieve your data before deletion.

6. Disclaimers

The service is provided "as is" and "as available." To the fullest extent Arizona law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-interruption. Anni is an organizational tool: it does not replace your school's official systems of record for grades, attendance, or emergencies, and you should not treat it as the only copy of anything legally required to be kept elsewhere.

7. Limitation of liability

To the fullest extent Arizona law allows, neither party is liable to the other for indirect, incidental, special, consequential, or punitive damages, and our total aggregate liability arising out of the service is limited to the greater of one hundred dollars ($100) or the amount you paid us for the service in the twelve months before the claim. Nothing in these terms limits liability that cannot lawfully be limited, and nothing in this section limits our breach-notification duties under A.R.S. § 18-552 or any other liability that cannot lawfully be limited. A signed Data Privacy Agreement carries its own matching limitation of liability.

8. Indemnity

To the extent permitted by the law applicable to you (public school employees and entities are bound only as far as Arizona law allows), you are responsible for claims arising from content you had no authority to store or share, or from your violation of law or these terms. If the Anni software itself, used as provided, is found to infringe another party's intellectual property, our obligation is to fix or replace the infringing feature or, failing that, refund any fees you paid for the affected period; that is the exclusive remedy for infringement.

9. Termination

You can stop using Anni at any time and can permanently delete your account and all of its data yourself in Settings. We may suspend or terminate for material breach of these terms, with notice and a chance to retrieve data except where protecting other users requires acting immediately. Sections that by their nature survive (your ownership of content, privacy commitments for data still held, disclaimers, liability limits, governing law) survive termination.

10. Governing law and disputes

These terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Maricopa County, Arizona, and both parties consent to that venue. Before filing anything, each party agrees to email the other a plain description of the problem and allow 30 days to fix it.

11. Changes to these terms

We may update these terms as the service evolves. For material changes we will post prominent notice on the service before the change takes effect, and continued use after the effective date is acceptance. The effective date above always reflects the current version.
